I would suspect that you would get approval of your I140 EB1EA because it seems that you don't have the quality of an alien with EA. You continue to come here to ask this kind of nosense questions and that you have a bad lawyer. If you have the quality of an alien with EB1EA you should be able to make a such an easy dicision.
Obviously, you should fire the lawyer and file the I485 right now by yourself.
I am very sad that many people are smart in doing research but stupid in making a real life decision.
