Of course, if you didn't do any thing, after you receive the H1-B approval and OPT expired, you still stay in the country, you are out of status. But, if your accumulated out-of-status days is less than 180 days, you can still file I-485 in the country later, you will pay penalty of $1,000, plus the fee to hire a really good lawyer. Consulte a good lawyer, before you want to do this way.
