Thanks for the article from www.gtlaw.com . I think EB3 may face possible retrogression if BEC speeds up the labor process. But so far, I don't see BEC speeding up their process. In my company, there are couple pending non-RIR labor applications pending in BEC. These labor applications were filed back to 2002 including my original labor application. I was lucky to get a sub-labor to file I-140/I-485 in May 2005. But anyway these labors are still pending in BEC, so applicants without labor approved cannot delay the current EB3 I-485 PD.
IMHO: EB3 may retrogress if BEC speeds up the labor process.
