First I would say, don't be aghast. Contact some attorney friends or BCIS directly and clarify your situation to see if there was any misunderstandings and get solutions. I don't quite understand the response from BCIS. As I know, the status of a person during the OPT is still legal (F-1 status) no matter he has a job or not, especially under the current tough job market. If only keeping a job can make one in legal OPT status, does that mean one must keep working status during the entire OPT period? For instance, if one graduates in May and his OPT expires in May the next year, but he/she does not get a job until November this year, does that mean that he is out of status between July and November this year? Or he has to file a change of status by July in case he will be out of status because who knows whether he will get a job in the future? If this is the situation, then I guess the validity period of OPT is not one year, but 2 months! This is ridiculous.
