Do you mean a new H1-B pending allows me to have a non-immigrant status? Therefore as my new H1-B application gets approved, my H1-B status is valid? Is this correct? My old question is attached below:

I was in dual H1B and I-485 pending status before my previous employment terminated on June 15. My new employer applied for H-1B on June 14(one day before the termination of my previous employment) for my new employment starting from August 16.(There is a gap between the two employments). I have only I-485 pending status (plus H1-B pendig status). (1) Will the application filed by the new employer have any adverse effect to my I-485? (2) Can I go back to H1-B status from soly immigrant I-485 pending status while my H1-B is pending? (3) Do I have a valid H1-B status after Aug. 16? (4) Do I need to use EAD to work for my new employer?
