Can I start to work after H1B is filed?

Hi, Thank you in advance.

I was laid off on 04/11/06. so my last h1-b was terminated on 04/11. I filed h4 application one week after it. Now H4 is still pending.

I have waited for my new company to file my new h1-B for 5 weeks. We are still waiting prevailing wage determination from the state for the second time. The first time it came back as level iii which is higher than my salary. They made some changes and submiited to the state again. Hopefully it will come back as level ii. I wonder if we submit h1b next week, Can I start to work as long as the H1B case is filed? Or I have to wait for it gets approval. I hear if the h1-b is filed after 2 month which is 06/11/06, I will have to wait to work after the h1b is approved. is that the case?

The lawyer told me the officer assured her that we can get the result before the end of this week, But she told me same thing for weeks. She never followed up and call officer to check the status. so it does not come tomorrow, I would like to tell HR that we need to file this next week (before 06/11) to avoid my waiting until it approval. They will use the premium process, but i have waited for it 5 weeks for such a simple thing, It is difficult for me to wait another month.
