What You need to prove is that your application or say your experitise will be greatly affected if a LC is required. That's the one of three requirement for NIW. This is different from any technical difficulty. What you need to do is argue that your work is so important, CIS should grant you green card regardless of the LC, not that you cannot get a LC. If you still cannot understand what I am saying here, find a good immigration lawyer, who should be able to clarify it.
