回複:I-140 please help, thanks!

First, you need to check whether your company has been paying you the proffered wage stated in your PERM from the day your company filed PERM for you. If the answer is yes, you don't need to worry about the negative net income.

If you are not paid proffered wage, your company should look at net asset. If your company's net asset is positive and is greater than the difference between the wage you are getting paid and the proffered wage, your I-140 will get approved.

But if your company's net asset and net income are both negative, and you haven't been paid proffered wage from priority date, you migth get a RFE for ability to pay even if your company employs over 100 people.

Hope this is helpful.
