thing is hopeful but still tricky. Theoritically, 1099 income indicates that your has your own business. The source of 1099 is your H1B employer just means that your business gets contracts from your H1B employer. And you work on your own for your company. By law, non-immigrant is not allowed to work for any employer without a work authorization no matter it makes profit or ends up with loss. If a CIS officer intepretes law this way, you will have trouble. Consult with a good lawyer to seek legal defense on that.
