Help with H1B Visa Application

Dear all:

I applied AP at TSC three months ago and have not received the approval notice yet. My H1b will expire at the end of July and I have already filed the extension (have not received the approval). If I plan to go back China soon, is there any risk to use my current H1b (will expire at the end of July) to apply for visa (I will come back before it expires)? Anybody has similar situation? Thanks a lot for your help!
