1. By lawy,only Master itself will qualify you as EB2. But if the job description says that the minimal requirement is PHD or MS+5 years, you have to use PHD or MS+5year to satisfy the job requiement. Otherwise, you will have problem in your 140.
2. I think so. In addition, if school can state that you satisfy all academic requirements by June, you meet the requirement of being a PHD already.
