Based on CIS policy back in 2001, you are still eligible for a H-1B transfer even with such a short gap when the gap is filled with a legal status. Tell the truth and it won't hurt. The H4 application is the bridge in this situation. You can write to withdraw it after your H-1B applicaiton is filed. However, it is hard to say if you are able to withdraw it even you request such a withdraw. It may cause a potential problem if the H4 is approved after your H1-transfer is approved. Then theoritcally, you have to leave and come back again on H1 visa. In many cases, CIS officer will do you a favor by dening the bridge case after approving your H-1B transfer whether you request it or not.
