Theoretically, whenever you apply US visa, you have a chance being denied. But I think the chance is low. There is a background check. It depends on what the area you are working. If it is very sensitive area, it may take for a while; otherwise you should be OK. More and more H-1b go back China and get their visa to come back. But again, no one can guarantee you.
