I think you mean your employer doesn't want to pay for your H1B petition, but they will give you the paperwork you need for H1B. If this is the case, let's continue discussing. If not, there is no disussion, you need to either change an employer or status soon.

Hope this is the first case I mentioned. If you have family(e.g., spouse, children,..) depending on your status to stay in US, I suggest you find a lawyer to do it.

The noremal procedure is to file I129 and maybe I539.
For you,
1) Labor Condition Application (LCA). This one needs to go through labor department to show your pay is up to the standard of prevailing slary. After you got LCA approved, then you can file H1B petition. This process is simplified and can be done online or by fax now. Search on internet for labor department, you'll see it.
2) I129.
3) Copies of your diploma(s).
4) A copy of your resume.
5) A copy of you first page of passport and the page(s) of your US visa.
6) A copy of your I94.
7) Paperwork from your employer. This is to show this company is an operating company with some empoyees, and earn profits ervey year. Of course, they pay taxes. This is also an important paperwork to show them your employer is a regular business not a hollow company.
8) A copy of offer letter from your employer to show they are willing to hire you and pay you. The salary should be on there.
9) Statement to indicate why you are suitable for this position. What kinds of skills or education you have to fit into this position. (Some people didn't file this or didn't write it correctly, and got rejected. This is the major fucntion of the lawyer here to package you to come up with a good statement.)
10) Application fee in money order.

For your family/dependents:
1) I539.
2) Copy of the first page of passport. Copy of US visa.
3) A copy of I94.
4) Marrage certificate in English (for spouse only). For childre not born in US, probably you need to show their birth certificate in English(I'm not sure about this one).
5) Application fee in money order.
