Nobody know how much chance for name check,but it's possible,computers system have too many possibilities for military ,but you may keep your passport during name check period if you have a reasonable reason.
If you use AP,your H1B will be denied,& maybe you won't get any visa at any US consulate in future.
2,I think your status will change to AOS,you have to leave USA to get a new H1B visa.
