help for denied I-131, Xiaobatu and mytwocents!

My wife and son's AP was denied, the reason is as following:

...the applicant is requesting U.S Citizenship and Immigration Service issue a Reentry Permit under Title 8 ,code of Federal regulations, Part 223.

Title 8, Code of Federal Regulation,Part 223.1 Purpose of Document, states in pertinent part regarding the issuance of ... ...

Title 8 Code of Federal Regulations,PArt 223.2(b) Eligibility--, ... ...

The record in this case fails to establish that the applicant is a lawful permanent resident or conditional permanent resident of the United States. It's therefore concluded that the applicant is not eligible to receive a reentry permit.

They are holding H-4, and my I-140 was approved last year and I-485 are pending, when applying I-131, we sent H-4 copies and I-485 pending notice, why say fail to establish a lawful resident?

What can we do? Appeal? How? Thanks in advance!!!
