請教高手們，I-140 被拒之後的appealing 機會有多大？

我剛拿到I-140被拒通知書 (Eb-1 as outstanding researcher)。 唯一的理由是因為沒有交 official job offer letter in the initial application(律師沒有告訴我）。 （sorry, I am from southern China and cannot use 拚音 efficiently）. Now my question is: do I have a chance to appeal successfully? my lawyer told me that it will take 18 months in average to appeal and during this time I cannot file new application under the same category. So, what will be the efficient way: file an appealling with $385 or start over from the scratch under the same category (because I am in the Nebraska center and NIW is almost impossible here)? I remember someone said that the PR decision will be only based on the initial materials you provided. Is that true?
