There have been nationwide discussions among immigration attorneys about the delay in national security checks. There are only two avenues for this problem. One is to wait it out, which could take anywhere from 6 months to 3 years. The other avenue is to file a federal mandamus action to compel CIS to adjudicate the national security check quickly.
There are 380,000.00 cases backlogged due to national security checks. The AILA liaison now indicates they cannot provide us with productive assistance in these matters. We have had numerous clients hire us to file mandamus actions. Most of them have been engineers or physicians still employed by their petitioners.
Filing a federal mandamus action speeds up the name check process. We normally hear from them within 3 weeks to 3 months. However the attorney fee varies from case to case. It depends on the family size. Usually 4000.00 to 5000.00.
