我這種情況應該從新file perm嗎？

2003年遞的LC (using regular process),到現在一點消息都沒有。現在公司同意我們從新
file using PERM。我現在的case是EB3。我目前有3各options:
1. refile using PERM to apply LC. if the new case is identical to my existing case, DOL could keep my priority date (end of 2003). But the risk is DOL will decide if two cases are identical or not. if they reject, then I will loss my priority date.
2. start over a new case using PERM and apply under EB2. then I will loss my priority date for sure. but EB2現在的排期推進得很快．我或許可以更早開始申請485.
3. nothing to do. just keep my current case and wait for LC, 然後等到排期後遞交140 and 485

我的H1b到２００９年底就要滿６年了。
