The RIR conversion eligible alien beneficiaries have an option to file a PERM application with or without requesting retention of the original priority date. However, when one files PERM with the request to retain the priority date, currently the risk is still very high in terms of the priority date. The decision can end up losing priority date if the PERM application is denied or BEC application is considered withdrawn even if the PERM is approved in the event that the BEC determines that the two cases are "not" identical cases. In this case, the alien loses the original priority date.
