1. That happened before the new rule completely took effect.
2. In law, what you mentioned is OK. CIS officer sometimes even do you a favor by denying the bridge case after approving the desired status to avoid the second risk I described previously . Untimely filing do not necessarily means that an application can not be approved. CIS memo does not say something such that "the following cases will be denied also". Terminology in law is more complicated than what we think.
Anyway, if the bridge case is denied when the following case is pending, CIS officer can and will likely deny the second case by using the untimely filing as a ground. The unlawful presence starts at the time the first case is denied.
The risk does exist, however I also suggest people doing the same if there is no other way to avoid a gap.
