1.When computing unlawful presence, you need to consider grace time of two months..
2.For Students on F or J who are admitted to the U.S. with an I-94 without any specific expiration date but rather with Duration of Status (D/S) and do not accumulate unlawful presence, no matter how long they stayed in the country illegally, unless they are detected and determined by the Immigration Judge or Immigration Officials. 也就是說隻有Immigration Judge or Immigration Officials能決定你是不是OUT OF STATUS. However, your gap will be found out if you try immigration benefit such as AOS later. You may have to leave to fix your problem. However the risk is very high. Talk to an experienced lawyer for a good solution.
