There is not gray period on your status. As long as your application for H4 was filed before your F1 expired, you are fine, perfectly legal.
Now, let's address your concern if using AP is safe. You have no problem to coming back on AP unless you have a status gap of over 180 days. However, if your hu*****and's 140 has not been approved, there is slight risk in case of a 140 denial. This issue is still in controversy and I personally believe that using AP is risk free. However, I still advise you to come back on H4 under this situation. Obtaining a H4 visa is kind of easy in China right now.
