You must proved evidence which addresses your eligibility under each of the following:
Eligibility for the requested waiver entails demonstrating that the national interest would be adversely affected if a labor certification were required. You must demonstrate that it would be contrary to the national interest to potentially deprive the prospective employer of your services by making available to US workers the position you seek. If self-employed, you must also establish the national interest would be adversely affected if a labor certificate were required.
***Basically, you need to prove that the benefits you will bring the US is bigger than the purpose of LC which is to protect American workers. You would prove this by showing that your achivements are higher than other researchers, and you have made impacts on other researchers as well as the whole field.
If you demonstrate that you hold a patent or are responsible for an innovation, then you must demonstrate that the specific innovation serves the national interest.
***A patent itself does not mean a lot. The key is to prove that the patent is beneficial to the US or American people. It is better if the patent is in commercial use now.
You must establish you have a past record of specific prior achievement which justifies projections of future benefit to the national interest. You must establish, in some capacity, your ability to serve the national interest to a substantially greater extent than the majority of your colleagues. You must demonstrate to some degree your influence on your field of employment as a whole.
*** This part is very clear.
Please submit copies of grant applications/award documents for all research in which you are currently participating or participated in previously. The complete documents are not requested but please submit all cover pages and pages identifying the research participants and roles.
Please submit copies pf any published articles by other researchers citing or otherwise recognizing your research and/or contributions.
