急：回國結婚問題

各位高人前輩： 小弟已遞交I140（未批）， 485（未批）； AP已批，想回國結婚。
問：1）還沒用過AP， LP可以簽H4出來嗎？
2） 如果用過AP， 雇主沒換， 沒使用EAD （仍然是H1）， LP可以簽H4 嗎？
