Differnet school of thoughts on this. Some attorneys recommend using H1B because using AP will invalidate your H1B and in case your I485 is denied you will be out of status. Some more liberal attorneys say it will not invaidate H1B if you use AP as long as you will work for the same employer.

You can definitely apply for H1B to return to US. In fact that is what's recommended by a lot of attorneys.
