B2延期批準 was not approved, is it a serious problem?

hi,

my in-law applied the extension 3 years ago. However we didn't aware of the
fee change during that period(the check we sent was returned), and then we
sent in again with another check. But after that we didn't head anything from
INS until in-law left(stayed around 11 months). During the last 2 years we
moved a couple of times. Last year we received the rejection letter from INS
that they dropped the case because they didn't receive the 2nd check, but we
didn't do anything because we thought it was two years ago, not sure if the
case was there or not.

Anybody suggest what we should do? We planed to ask the in-law to apply for
visa again with the receipt, is it a serious problem if VO asks 延期批準?
