By the way, I did not even start using my EAD until Sep 15, 2001 (the EAD approved on June 22nd, 2001). The EAD expired on March 22nd, 2002 and my first H1B approval notice was issued on Marh 19nd, 2002. At least, I don't think there is a gap between the EAD and H1B approval notice.

My personal thought about why this happened is the following two reasons.

1. I did not attach a copy of the back of the EAD card when I sent my first reply to the RFE (they sent me an RFE first, then a Note of Intent to Deny). In the RFE, they listed three things (I20 (front and back, althought nothing on I20's back), I94s, All approval notices for change of status). They did not mention the requirement for EAD. So, I only made a copy of the front of the card. But when I called national customer Service center this morning, they said that I need to send in both the front and back of the EAD card.

2. When I made the copy of the front of the EAD card for the response to their RFE, the image of the picture is located at the right corner of the paper. I should have put it in the middle of the page. Anyways, I sent them quite a few pages because I have quite a few visas and I94s. I am guessing there is a small chance that they either misplaced or overlooked that page. but that's just my little wish......

At last, in the Note of Intent to Deny, the only evidence they are asking for is the EAD. They did not mention anything about the H1B approval notices or I94. So, I am guessing there is a good chance that they never saw the copy of the front of the EAD card or they do require both the front and the back. But who knows!
