Usually you shoule appeal wintin 30 days since your 140
application getting denial,but you may try to file an
appeal because you never received a deniel notice,write
a letter to the service center where denied your I-140
to ask the result,then they will send u a denial notice again,and attach a form 290B for your appeal,
BTW,it's very important to know the reason of denial that showing on the notice for your appeal.
If you want to resubmit your I-485,you have to wait
the immigration visa number to become current.
