H-4 visa

Dear all,

I am looking for some suggestion from H-4 holder who have been back to China and come back to U.S. safely.

My background: F2-F1-H4, in U.S.7 years, having a baby 2 years old
My hu*****and's background: F1-H1 (postdoctoral)-H1 (visiting assistant professor) in U.S. 7.5 years, going back China once in 2002
Both having I140 and I485 pending, having AP and EAD, I140 will have the result within 60 days.

Due to family emergency, I need to go back to China for 3 or 4 months. My hu*****and’s H-1B will be valid until 06/2007. Therefore, his valid H-1B visa is one year left.

My Question is:
Will the visa officer issue one year H-4 visa to me? Are those matters: changing status, immigration purpose, short time H-1B visa of my hu*****and and not going back to China within 7 years?
