no can answer your questions i believe
the point is:
1) you have to leave this country
2) there is always risks when you apply a visa (H1 or H4) at any consulates
3) if you are asking you choose H1 or H4, IMO, H1 is better as you can work when you come back, but H2 seems a little easier to get than H1. it's totally up to you
