Ask for suggestions for my H1-B situation

I don't have the paychecks from last 3 months from my current company. Now
a new company gives me an offer and the lawyer told me to go back to China,
he will file a new H1-B application for me. I am afraid that even so, the officer from US consulate will ask me to provide the paychecks from last 3 months. Ask for suggestions on my case!
