H-1b transfer

Hate to bother you guys with something like this and I am sure it has been discussed before, but I would really really appreciate input on this issue:

I am in H-1b, waiting to be transfered to a new company. My lawyer is now telling me that he first needs to get an approval from the state labor board for the "prevailing wage" requirement, which takes 10 days. My lawyer is also telling me that, however, I can begin working for the new employer now, even though the application to the immigration services was not even turned in (my lawyer did submit an application to the Department of Labor).

I am worried that my lawyer may be wrong...can anyone help? How and what does it take for a H-1b to transfer his job? Your help is highly appreciated!!! Thank you!!!
