It is good that your employer is suporttive. However what they have done is not enough, you need to be on their payroll to be in status. Right now H-1 transfer generally needs the latest pay stubs. Ask your employer to put you on leave without pay, holding your last pay (including severance and you vacation salary) until you need them for a successful H-1 transfer.
