1. Yes, you can take severance package, no problem
2. Yes, you can take unemployment insurance benefit, however you expose your layoff status to the government unless you have a backup status, such as a pending application. Someone got deported because state government reported the unemployment insurance benefit claim to the INS. When being out of status, keep low key please.
