求教一個關於AOS的問題

My wife was in H4 via and it become AOS after return from China using AP recently. We would like to know whether her status is illegal once our I-140 got refused? If yes, will there be any grace period? Could she obtain H4 inside US or does she has to do it outside US? Will our GC application history influence her H4 application?
