The advantage of maintaining a nonimmigrant status is that if something goes wrong with your 485, you do not have to leave. However, after 140 is approved, the chance of a wrong 485 is very slim. So your LG have three options 1)apply OPT, then H1, maintaing a status other than AOS.2) just use EAD to work. 3)OPT-H4-EAD(AOS), however, as long as your LG starts to use EAD, he lose h4 and become AOS.

By the way, once your LG files 539 before May to change status to H4, he is fine. There is no status gap whatsoever. So do not worry, time is enough.
