1,You may write to the USCIS service center where approved your H1B to notify them ,explain you never work for the employer, so the H1B should be thought is unavaliable.Then you send the letter through registered mail with receipt return,USCIS will stamp on the post receipt and return it to you,you also should keep a copy of your letter with the receipt as
an evidence.

2,If your new H1B period may start before your OPT expiring,that's ok.
