回複:H4 overstay, please help !!!

My dependents had the same problem. We were depressed and frustrated for a long time.

We applied for extention for their H4 visa on time. However, the officer rejected our application. Although the USCISS said they sent us a letter of the rejection. We did not received it. When we knew the result (we called that office), they had overstayed for 3 months. The reason for rejection was that my dependents' Chinese passports were expired. In fact, we had their passports renewed before filling an application. We hired a law to help us. The law filed a motion to repen the cases. Finally, we spent more than 1000 dollars to resolve the problem. My law told me that there would be more troubles if they overstayed for 180 days.

According to the law, if someone overstay illigelly for more than 180 days, she/he will be banned for 3 years (is not permitted to enter the US for 3 years).

I suggest that you should find a good law to help you to solve the problem as soon as possible.

Good luck to your and your family.
