My child should appl H4 or B2?

My son applied B2 alone last year (an agent suggested to apply B2, he said otherwise one of us should go back to apply H4 for our son or we should write some paper to entrust someone else) , and it got rejected. The reason is I did not go back for these years. We changed our status in US (B1->H1, H4-F1). If the application is rejected again, can I hire a lawer to do something for us?

We'll appreciate if someone can give your suggestion or share your experience.
