Employer cannot change job code, not higher, not lower. Because certain job level have certain target population, by hiring an overqualified person, in your case, you, will hurt local labor market.

This is why the DOL is very strict on this kind of change. So you may have to accept level 3 pay, or find another position of level 4 pay, which could be a lot harder.
