EB2 or EB3 on my position

I got an offer which is really good. It is up in the 80% of the same postion on salary.com But my boss told me he can only file EB-3 for me since he is bounded to hire a master for the position if I leave the comany. But the position is a senior postion whihc normally requires 5 yr experiences and a bachelor. But he thinks he might hire someone with less than 5 years and he is not committed to do eb-2. I just wonder can he set up two positions with similar job deions and one requires master or 5 year experience, the other with less experience and a bachelor and apply me to the first one. the difference is the salary. I am pretty sure I am above the level 4 on my job code. Anyway to pursaude my boss on this? Also can he change the job deion later on when I leave the company? that is his main concern.
