Dear friends - Xiaobaitu
Having seen your message in this community, I feel that you are a very knowledgable person and provide many valuble information and suggestion to the desperated folks.
I need your advices:
I am H1-B, three years ago get H1-B visa in Beijing (F1-H1), now I plan to visit my parents during spring festival, so I have to take the visa interview.
In filling the DS-156 for visa application in China (Beijing), item #
31 ask - "Has anyone ever filed an immigration visa petition on your behalf?"
I just got I-140 approved, but not yet file I-485 (EB-3). Should I fill in Yes or NO?
or what is the criteria to be considered as "file immigrant visa", as long as you start the Labor Certificate process or after filing I-485?
It always says that the visa official should not reject your visa because the inmigrant intend to H1 visa holder, but I just feel un-sure.
Or, what will be the worst scenario for me?
I feel very much concerns, becasue if I can't come back to US, then there will be big turbulances to my family as many many others do, becuase my wife and kid are in US as dependent.
