If not, you might be in trouble. I assume you are on H4 for nearly 6 yrs too, right? If so, you are in trouble. Since I-140 is for him only, it has nothing to do with you. Only when you two file I-485, you can become AOS. Thus if you haven't file 485, you (not yoru hubby) need to maintain H4. Ask a lawyer whether your hubby's new extension of H1 can carry H4, since CIS does not specially say anything about H4 in this case, it only mentioned H1.
