Ask 198151

Hi, 198151:
Seems you are familiar with immigration law. I have further questions regarding to EAD and H1B. My I-140 is approved (both EB1a and NIW). My 485 based on NIW is pending. But I want to work in the area different from the area I mentioned in my GC application. Basically I can do two ways:
1. EAD, then if INS ask the evidence of employment, switch to H1B. But it seems necessary to go outside USA for the switch, according to the Fan-law article.
2. H1B, then it is easy for INS to find out I changed area. My I-485 will be denied.

Could you give me some opinion?
