If you use your EAD, you will lose your H-1B status. However, AP is a much trickier question. The immigration legal counsel my company uses is firm of the opinion that: using AP will NOT invalidate H-1B status. He claims that Bill Yates, the director of INS, has confirmed this stand many times during the years. I also heard that the counsel of Yale University issued a memo stating the same opinion (Can anyone confirm?). However, some other attornies are of complete opposite position. The attorney of my wife's company is among one of them. There are different opinions on the internet also. I have used AP many times during the past 2 years and just extended my H-1B without any problem. However, it is one of those gray areas. Hence, it is best to keep a valid EAD card all the time. In the event that the ruling of INS changes, you still have legal status and will not be affected.
