I had similar problem last month when I changed employer. The H1B petition was submitted too late, right on the day I planned to start working for the new employer. I consulted employer's lawyer right away and he insisted that I shall start getting paid AFTER USCIS received my H1B transfer petition and put it into the system. So I had 3 days off until it is absoluatly "safe". Not sure what other lawyer would say though.
