If 140沒批, which means EB3 or EB2-1 I-140 is filed which first requires LC/PERM approval.
So if your approved/pending LC/PERM was filed 365 days or more before your current H1 expiration date, you can ask the 7th year in your next I-129 petition. The total period you can ask in your next I-129 is 1 year if current H1 expires at the end of 6th H year, or if you have time remaining in your 6 years, you can ask the remaining time + 1 year in your next I-129, but no more than 3 years (that is, if 2+ years remaining in 6-year limit) your next I-129.
