When the case reaches AAO, it is reviewed under serious scrutiny, and court officers at AAO are highly qualified experts. So if your case is not very strong, you want the first line USCIS officers (whose quality/training varies a lot) to approve your case, so you might choose to re-file I-140 if denied. Only go through appeal process when you do have a strong case.
