You need to provide a detailed statement letter to prove your English proficiency. A PhD degree isn't sufficient. You can list your education/training in English, your publication in English, your use of English both academically and in daily communication. TOEFL and GRE score doesn't seem to count that much, but a photocopy of them won't hurt you, if you got high score on that.
I sent my FBI record with other application documents in the first package. I just got my file case number. Still waiting for the second and third letter, so I dont' know if you can submit it later. Many say you should submit the FBI record upon request in the second letter, but some say doing so will make you longer. I really dont' know.
